1. Acceptance of These Terms
By using the Site, you agree to these Terms and to our Privacy Policy at https://www.mack-interactive.com/privacy-policy/. If you do not agree, please do not use the Site.
2. Client Engagements Are Separate
These Terms cover your use of the Site only. If you hire Mack Interactive for services, that work is governed by a separate written agreement between you and us. If that agreement conflicts with these Terms, the written agreement controls for that engagement.
3. Using the Site
You may use the Site for lawful purposes, such as learning about our services and contacting us. When using the Site, you agree not to:- Break any law or regulation
- Try to hack, disrupt, overload, or gain unauthorized access to the Site or its systems
- Use bots, scrapers, or similar tools to collect content or data from the Site without our permission
- Submit false information, spam, or anything harmful, such as viruses or malicious code
- Pretend to be someone else or misrepresent your connection with any person or business
4. No Guarantee of Specific Results
The information on the Site, including case studies, examples, and descriptions of our services, is for general information only. Marketing and business results depend on many factors outside our control, such as your market, competition, budget, and how platforms like search engines and social networks change over time. We do not guarantee any specific marketing, traffic, lead, sales, ranking, or revenue results. Past results shown on the Site do not promise future results.
5. Demo and Concept Builds
Some work shown on the Site may be demo or concept builds. These are labeled as such. They are examples created to show our capabilities and approach. They may not be live client projects, may not be affiliated with or endorsed by any business they depict, and may not reflect a finished product.
6. Intellectual Property
The Site and everything on it, including text, graphics, logos, designs, images, code, and the Mack Interactive name and brand, belong to Mack Interactive or our licensors and are protected by copyright, trademark, and other laws. You may view and share links to the Site for personal or internal business use. You may not copy, reproduce, modify, sell, or otherwise use our content without our written permission.
7. Your Submissions
When you send us information through the Site (for example, through a form), you confirm that the information is accurate and that you have the right to share it. We will handle your personal information as described in our Privacy Policy.
If you send us ideas, feedback, or suggestions about the Site or our services, you agree we may use them without any obligation to you. Please do not send us confidential information through the Site's forms unless we have a written agreement that covers it.
8. Text Messages
If you check the optional text message consent box on one of our forms, we may send you non-marketing text messages about your Strategy Call request, appointment reminders, and follow-up on your inquiry, from (267) 930-2542. Our text messages are non-marketing only. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of any purchase. See Section 6 of our Privacy Policy for details.
9. Third-Party Links and Tools
The Site may include links to, or features provided by, third-party websites and tools (for example, analytics, forms, scheduling, or email tools). We do not control these third parties and are not responsible for their content, services, or practices. Your use of them is at your own risk and may be subject to their own terms and privacy policies.
10. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Site will always be available, error free, or secure, or that any content is complete or up to date.
11. Limitation of Liability
To the fullest extent the law allows, Mack Interactive and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising from or related to your use of, or inability to use, the Site, even if we were told such damages were possible.
To the fullest extent the law allows, our total liability for any claim related to the Site will not exceed one hundred U.S. dollars (US$100). Some places do not allow certain limits on liability, so some of these limits may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Mack Interactive and its owners, employees, and contractors from any claims, losses, damages, and expenses (including reasonable attorneys' fees) that arise from your misuse of the Site, your violation of these Terms, or your violation of anyone else's rights.
13. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law rules. Any dispute related to these Terms or the Site will be brought only in the state or federal courts located in Philadelphia County, Pennsylvania, and you agree to the jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the new version on this page and update the "Last updated" date above. If you keep using the Site after changes are posted, you accept the updated Terms.
15. General
If any part of these Terms is found unenforceable, the rest will stay in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms and our Privacy Policy are the entire agreement between you and us about your use of the Site.
